My Chicago office gets many calls regarding what it takes to have a hostile work environment in Illinois. Many people are confused about what is covered under the law. What isn’t a hostile work environment is general harassment. There is no protection under the law is the boss is just a jerk to everyone. So if the boss yells all the time and is just not a nice person, there really isn’t anything you can do. A few years ago there was an effort to pass a bullying law but that effort failed. So in order to have a true hostile work environment that is actionable in Illinois there must be a form of discrimination.
